If a Donnybrook build has ended in a dispute, VCAT will want an expert report written to its expert evidence practice note. Ours is independent and covers each defect, the requirement it falls short of and the work needed to put it right.
One of our inspectors will call you back.

Building Dispute Practitioners Society Following VCAT Practice Note PNVCAT2, the report compares the building work with the contract, its plans and specifications, the National Construction Code, the applicable Australian Standards and the Guide to Standards and Tolerances that matches the contract date.
19 checkpoints across 6 areas on a standard Donnybrook vcat expert witness report. Where something is locked, sealed or buried under stored material on the day, it goes in the report as not inspected. We never mark unreachable work as satisfactory.
Examples from recent inspections around Donnybrook.

New Construction Stage Inspections Seven checks through a Donnybrook build, each timed for the moment before the work vanishes behind the next trade.
Pre-Handover (PCI) Inspections The inspection before keys change hands, where code items still surface alongside the finishes.
Building and Pest Inspections Building and timber pest together, starting with whether the termite barrier has been bridged.
Defect Investigation Reports Measuring what failed against what was required, so the argument stops being about opinion. Instant online pricing for Donnybrook, or contact the booking team.
For most disputes it is. A domestic building work dispute cannot go to VCAT until the Building and Plumbing Commission's dispute resolution service (formerly DBDRV) issues a certificate of conciliation, confirming the dispute was unsuitable for conciliation or did not resolve. Only an application for an injunction can skip that step. Before you approach the service, set out the defects to your builder in writing.
Yes. Listing each defect with the requirement it fails and the fix gives the conciliation officer and the builder something concrete to answer, and the service may also send an assessor of its own to inspect. If the dispute moves to VCAT, the tribunal's building disputes practice note says any available expert report on incomplete or defective work should be lodged with the application.
To VCAT. The practice note PNVCAT2 gives an expert witness a paramount duty to the tribunal, ahead of the party paying, and an expert is not an advocate for either side. That is why the report notes acceptable work alongside the defects.
It requires a signed declaration together with the expert's qualifications and experience, all instructions received, the documents reviewed, the facts and assumptions relied on, a summary of the opinions and any matter outside the expert's field. Where the report recommends rectification, it must give the reasons, the likely cost and whether there is a reasonable alternative. We support each item with photographs and measurements and name the clause it breaches.
The starting point is your contract, with its plans and specifications, because section 8 of the Domestic Building Contracts Act 1995 implies warranties that the builder keeps to them, complies with the law including the Building Act 1993, and takes reasonable care and skill. We also assess the work against the National Construction Code and the Australian Standards that apply, such as AS 2870 for slabs, AS 3740 for wet areas and AS 1684 for timber framing. Finish quality and allowable tolerances are taken from the Guide to Standards and Tolerances.
It depends on when your contract was signed. Contracts entered into, or work started, from 1 August 2026 fall under the 2026 Guide, while a home built under an earlier contract is assessed against the 2015 Guide. Either way the Guide is advisory, and the contract, the law, the NCC or a standard prevails where it differs.
There is. Section 134 of the Building Act 1993 shuts the door on a building action 10 years after the occupancy permit is issued, or 10 years after the certificate of final inspection if the house had no occupancy permit. The section 8 warranties pass with the home, so a later owner in Donnybrook can rely on them inside that period.
When VCAT directs it, yes. The tribunal can order experts to meet in a conclave, narrow their differences in good faith and file a joint report on what is agreed, what is not and the reasons, sometimes known as a Scott Schedule. In a more complex hearing the report is usually taken as read, and the experts may give evidence together as a panel.
It must be ready by the date in VCAT's orders. If none is set, PNVCAT2 requires filing and service at least 10 business days before the mediation, compulsory conference or hearing where the report will be relied on. A report that arrives late may be refused, so let us know the tribunal dates at the outset.
An experienced building inspector who attends the home, reviews the documents and signs the declaration the practice note requires. In keeping with VCAT's rules, the report sets out that inspector's qualifications and any relationship with you.
We prepare reports across the Donnybrook estates, including Olivine, Katalia, Kinbrook, Heartford, Acclaim and Platform, and in Kalkallo, Mickleham, Craigieburn and Epping North. The fee depends on how many items are disputed, the size of the home and the documents to read. Send the contract and your defect list and we will quote from those.
